APPLICANT REQUESTS THAT:

1.  He be awarded the Air Force Commendation Medal (AFCM).  
Administratively Corrected

2.  He be entitled to the Small Arms Expert Marksmanship Ribbon 
(SAEMR).

APPLICANT CONTENDS THAT:

The SAEMR is not listed on his DD Form 214, Armed Forces of the 
United States – Report of Transfer or Discharge.

In support of his request, the applicant provides a copy of 
Special Order G-124.

STATEMENT OF FACTS:

The applicant served in the Regular Air Force from 16 Aug 
1965 through 8 Aug 1969.

The SAEMR was authorized by the Secretary of the Air Force on 
28 Aug 1962. It is awarded to all Air Force service members who, 
after 1 Jan 1963, qualify as "expert" in small-arms marksmanship 
with either the M-16 rifle or issue handgun.

THE AIR FORCE EVALUATION:

AFPC/DPSID recommends denial of the applicant’s request for the 
SAEMR.  DPSID is unable to locate documentation verifying he 
qualified as "expert" with the M-16 rifle or issue handgun.  
Without the proper documentation it would be an injustice to 
grant his request as there is no verification that he met the 
qualification for the award of the SAEMR.

Notwithstanding the above, the AFCM and the Vietnam Service 
Medal with four Bronze Service Stars should have been awarded 
during the applicant's service from 16 Aug 1965 to 8 Aug 
1969 and were not reflected in his records.  Upon final Board 
decision, administrative correction of his official military 
personnel record will be completed by AFPC/DPSOR.

APPLICANT'S REVIEW OF THE AIR FORCE EVALUATION:

On 24 Jan 2014, a copy of the Air Force evaluation was forwarded 
to the applicant for review and comment within 30 days.  As of 
this date, no response has been received by this office (Exhibit 
D).

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided by 
existing law or regulations.

2.  The application was not timely filed; however, it is in the 
interest of justice to excuse the failure to timely file.

3.  Insufficient relevant evidence has been presented to 
demonstrate the existence of error or injustice.  We took notice 
of the applicant’s complete submission in judging the merits of 
the case; however, we agree with the opinion and recommendation 
of the Air Force office of primary responsibility and adopt its 
rationale as the basis for our conclusion that relief beyond 
that already granted administratively is not warranted.  
Therefore, in the absence of evidence to the contrary, we find 
no basis to recommend granting the relief sought in this 
application.

THE BOARD DETERMINES THAT:

The applicant be notified that the evidence presented did not 
demonstrate the existence of material error or injustice; that 
the application was denied without a personal appearance; and 
that the application will only be reconsidered upon the 
submission of newly discovered relevant evidence not considered 
with this application.
